Copyright

This website and its content may not be reproduced in any form without the permission of thirtypointfour design services. We have done our utmost to ensure all the content is correct and up to date. If we have overlooked any elements please do not hesitate to contact us.

Copyright on all material produced, remains the property of thirtypointfour until final payment is received from the client. We reserve the right to withhold copyright if full payment for all services is not received.

Pricing

We are registered for GST and as such all prices quoted in this website are excluding GST. We reserve the right to alter our pricing without prior notification (exlcuding quoted items), and as such we advise all customers to contact our office for an obligation free quotation. All our quotations are valid for 30 days. We reserve the right to change the quotation after this period taking in to consideration third party costs and charges.

Privacy & Communication

Any information received via newsletter subscription, email, telephone, post or fax will be deemed private and confidential. This information will only be made available to employees of thirtypointfour design and its associated partners in the completion of its work for that client. No information will be divulged to a third party without the permission of the client/s.

By subscribing to our newsletter we asume that you wish to receive our company newsltetter via email. We provide an unsubscribe link in every email sent.

Client Brief

Before commencing a project we send an outline brief to the client. This brief allows us to focus on the clients needs and requirements for the project. From this brief we put together an Initial quotation

Initial Quotation

From our clients breif we put together an outline proposal stating our recomendations and costs for the project

Acceptance of Design Proposal

Upon acceptance of our design proposal we require approval in writing from the client. An approval form is attached to all our proposals.

Deposit Invoice

Before commencing with the project a 40% deposit is required. An invoice will be sent to the client on acceptance of quotation.

Design proposal

On written acceptance of our outline quotation & receipt of deposit we will begin first stage design concepts. These concepts are then presented to the client for review

Client Appraisal

We allow for 2 revisions of the initial design proposal, to reach final artwork stage. If the process exceeds the aloted hours we will notify the client and estimate additional costs required to finalise the designs.

Development

Under the client’s direction, we develop the designs according to the project needs.

Requirements that are extra to our initial quotation will be submitted to the client for approval.

Testing & development

All websites are built and tested on our own closed network server.

When the site is complete and approval is given we upload the finished site to the live server.

Upload

Upload to our own managed servers is included in our costs. Upload to servers not managed by us is charged an hourley rate of $99.

Final Approval

When the client is satisfied with the website and associated artwork produced and colour matching, final approval must be give in writing

Early Termination

If for any reason you decide to terminate the contract please notify us as soon as possible. An initial design concept fee will be invoiced on termination of the project . The designs submitted must not be used, altered or reproduced in any form without consultation with thirtypointfour.

On termination of a project the copyright of all works remains the property of thirtypointfour at all times. Usage of any material produced by thirtypointfour will be regarded as breach of copyright.

Production of Printed Material

Upon final approval, artwork will be submitted to the chosen printer.

We will then submit a PDF proof of the artwork for final approval by the client. Hard copy proofs can be provided for $75.00 per proof.

On approval by both parties, printing may commence. Print approval must be given in writing to thirtypointfour.

Where printing is included within our quotation and final production is delayed by the client due to unforeseen circumstances, payment for all design work, excluding printing will be invoiced 14 days from the final approval date.

Printing of original artwork can be commenced at any point and the associated print charges will be invoiced separately. Changes made to artwork after this period may incur a design fee

Delivery

On completion of the printing or artwork production (artwork only projects), delivery will be made as directed by the client.

Any costs incurred to thirtypointfour in the delivery of artwork or printed material will be charged to the client

Post Print Changes and Errors

Any changes made to printed material, post production will be quoted separately and may incur a design and print management fee. Full payment for printing will usually be required

Thirtypointfour cannot be held responsible for any errors in client approved artwork. Full payment will be invoiced.

Printing errors as a result of production are the responsibility of the printer and thirtypointfour will do its up most to rectify any problems on behalf of the client at no additional charge.

Thirtypointfour accepts no liability for costs incurred by late delivery or additional time taken to re-print material.

Cancellation of Project

Prior to acceptance of our quotation the client has the right to terminate the project at any point. If due to unseen circumstances the project is terminated by the client after this point, full payment will be invoiced for all design work and any additional costs* incurred to date as follows:*

Any cost incurred by thirtypointfour design services in the production of the project that have been approved by the client prior to cancellation. Until payment is received the copyright of all artwork remains the property of thirtypointfour design services and must not be, altered or reproduced in any other form without the permission of thirtypointfour design services

Completion of Project

When the project is completed the final balance invoice will be sent.

Project Warranty

Thirtypointfour provides a 6 month warranty on all websites. This warranty covers the fixing of all issues arrising from errors in the sites construction.

This warranty does not include:

changes to site content
re-design or additions to site templates
changes in site specification
errors in third party software used on the site
upgrading your CMS version

Project Delay

If the project is delayed by the client due to: unforseen circumstances, delivery of content, approval of project ellements. Thirtypointfour reserves the right to re-schedule the work into the studio at a time that suits the current studio workflow. We will however try to accomodate all deadlines where possible. We do however accept no liability for costs incured by the re-scheduling of the project.

If a project is placed on hold for more than 6 months, full payment of costs to date will be invoiced.

Projects on hold for longer than 6 months may incur additional costs due to change in pricing structure or software updates required on project. All printed ellements and additional artworking, construction costs will be quoted at the current hourley rate.

Projects on hold for longer than a year will be archived and removed from our testing server.

Limitation of liability

Thirtypoinfour accepts no financial liabilty for damages or losses that arise not from the immediate act of one of the parties, but as a consequence of that act.

This means that we are not financialy liable for any costs incured by you the client due to:

Website hosting downtime
Website content errors
Errors due to thirdparty software
Payment gateway errors
Late delivery or project items due to unforseen circumstances beyond all parties control
Late delivery of printed material

Acts of God!!

Thirtypoinfour accepts no liabilty for costs incurred by the client where we are unable to complete our contract in the alocated timeline due to issues beyond our control including, fire, flood, loss of equipment due to theft or malfunction or sickness.

Payment of Invoices

All our invoices are strictly 14 days from invoice date. Full payment details are listed at the bottom of our invoices.

Late payment of Invoices will incur a penalty charge of 10%. This figure covers administration and banking fees.

We are more than happy to arrange individual payment terms for customers if we know beforehand. Please dont ask for credit terms when your invoice is 14 days overdue!!

Thirtypointfour reserves the right to withhold any material produced for the client pending final payment. As the copyright of all artwork remains the property of thirtypointfour design services until final payment is received, any usage, broadcast or distribution in any manner of works carried out is strictly prohibited

Where the name thirtypointfour is used within this document it refers to the company; Mark Carpenter trading as thirtypointfour design services.’
